88 Article (15): Eighth: Issuance of Decisions a. After the committee has finished hearing the evidence presented in the complaint, it shall conclude the investigation and adjourn the session for the purpose of issuing its recommendation. b. The investigation committee must issue its recommendation regarding the alleged violation within one week from the conclusion of the investigation, unless a justified reason exists to extend this period. c. The committee shall issue its recommendation by consensus or majority, provided that at least two members, including the Chair, are in agreement. d. The committee shall recommend conviction and the appropriate penalty if the violation is proven, declare acquittal if the evidence is insufficient to establish the student’s violation, or determine non-liability and close the investigation if the act attributed to the respondent does not constitute a disciplinary violation. e. The committee’s recommendation, in accordance with applicable law, must include the following: 1. Full name and status of the complainant 2. Full name of the respondent, their faculty, university ID number, and whether any prior disciplinary penalties have been imposed. 3. A summary of the facts, evidence, and reasons supporting conviction or acquittal. 4. The committee’s recommended course of action, and if the recommendation is for conviction, it must include a description of the violation, the applicable legal provision, the type of penalty the committee deems appropriate for the violating student, and the legal article authorizing its imposition. Article (16): Ninth – File Keeping a. The Investigation Committee shall be responsible for preparing a special register in which it records the complaints referred to it, including the name of the complainant and the respondent, the type of complaint, and a summary of the recommendation it issues regarding the violation that is the subject of the complaint. b. If the Investigation Committee to which a complaint has been referred is unable to decide on it due to the formation of a new committee at the beginning of the academic year, the complaint shall be followed up by the succeeding committee. c. Upon completion of all investigation procedures by the committee, and after the University President, the relevant Dean, or the relevant Director issues a decision regarding the complaint, the original decision shall be filed together with the complaint record in the office of the relevant Dean or the department to which the Investigation Committee is affiliated. The committee must also be duly informed of the decision issued concerning the complaint.
