86 Article (12): Fifth: Hearing Witnesses a. The Chair of the committee shall summon the witnesses mentioned in the complaint, as well as any witnesses identified by the respondent. The committee may also invite anyone it deems appropriate to provide information related to the complaint. b. Before hearing the testimony, the Chair shall administer the legal oath to the witness, swearing by Almighty God to tell the truth without addition or omission, and this shall be recorded in the minutes. If the witness is not Muslim or not of the People of the Book faith, the oath shall be administered according to the beliefs they adhere to. c. Before hearing the testimony, the Chair shall ask each witness for their full name, age, address, phone number if available, place of work or faculty, university ID number, and whether they know the respondent or have a familial, friendly, or hostile relationship with them. This information shall be recorded in the minutes. d. Each witness shall provide their testimony individually before the committee. e. If a witness refuses to take the legal oath without a legal justification, the refusal and its reason shall be recorded in the minutes, along with a notice that refusal may expose them to legal liability. If the witness persists in refusing, their testimony may be heard for guidance or consultation purposes, but it cannot be relied upon alone unless corroborated by other evidence. f. The testimony of a witness under fifteen (15) years of age shall be heard for guidance purposes without taking an oath, unless the witness understands the nature of the legal oath. g. After completing their testimony, the witness shall be given the opportunity to read their statement and, if desired, approve it by signing. If this is not possible, it shall be noted in the minutes with the reason for the inability h. If a witness refuses to testify without a legal excuse, the refusal and its reason shall be recorded in the minutes and confirmed by the committee members and the witness, unless the witness refuses to sign, in which case it shall be noted in the minutes along with a warning that refusal may expose them to legal liability.
