84 e. The investigation committees at the Dean of Student Affairs shall have jurisdiction over violations whose jurisdiction is disputed. f. If a violation involves both a student and a staff member, or includes cross-complaints between a student and a staff member, the committee formed by the University Presidency shall have jurisdiction to consider the entire case. g. If the respondent raises an objection during the investigation regarding the committee’s lack of jurisdiction or the inadmissibility of hearing the case due to prior adjudication by another committee, the committee must first rule on the objection before proceeding with the investigation in accordance with procedures. h. If the committee determines that it lacks jurisdiction over the violation, it shall declare its lack of jurisdiction and forward the case to the relevant Dean or Director to refer the complaint to the competent committee. i. If the committee determines that the subject of the complaint has already been adjudicated for the person against whom it was filed, it shall decide to archive the case. j. If, during the investigation, the committee finds that the respondent student, or any other student, has committed another violation not included in the original complaint either before the complaint date or during the investigation, the committee may notify the competent authority to initiate new proceedings in accordance with the proper procedures Article (10): Third: Notifications a. After the complaint is referred to the investigation committee by the competent authority, the committee shall prepare an investigative file. b. The Chair of the investigation committee shall notify the respondent in writing, by phone, electronically, via the faculty or center notice board, or through the relevant Dean’s Office, Dean of Student Affairs, Dean of Graduate Studies, or the Center Administration, depending on jurisdiction, to appear before the committee on a specified date. If the student refuses or fails to appear without an excuse accepted by the committee after being notified at least twice, the investigation shall proceed, and the student may be penalized in absentia. c. The Chair of the investigation committee shall convene the members for a meeting, ensuring that no fewer than two members, including the Chair, are present. The Chair shall be responsible for conducting the committee sessions, recording the minutes, and preparing dated reports in accordance with procedures.
